EULA - End User License Agreement

Protocall Computer Services (PCS) SOFTWARE LICENSE AGREEMENT for CaféTimePro

1. GRANT OF LICENSE. PCS SOFTWARE grants to you the nonexclusive
right to use one copy of the identified PCS SOFTWARE program CaféTime
Kiosk Software (the "SOFTWARE") on a single terminal connected to a
single computer in accordance with the terms of this Software License.
You may use the SOFTWARE on a network server only if you have obtained
a separate license for each terminal or computer that has the ability
to access the SOFTWARE from such network server. PCS SOFTWARE
reserves all rights not expressly granted to you. This license is
effective on the date you install the SOFTARE and will remain in force
until terminated. PCS SOFTWARE may terminate this license if you fail
to comply with this License Agreement. If this package is an update
to a previously licensed version of the SOFTWARE, you must either
keep the preceding versions of the SOFTWARE (including any disks and
documentation) with the update or you must destroy the prior versions
of the SOFTWARE.

2. COPYRIGHT. The SOFTWARE is owned by PCS
SOFTWARE and is protected by United States and Canadian copyright
laws and international treaty provisions. Therefore, you must comply
with such laws and treaties in your use of the SOFTWARE. You may not
copy the SOFTWARE except that you may either (a) make one copy of
the SOFTWARE solely for backup or archival purposes, or (b) you may
transfer the SOFTWARE to a single hard disk provided that you keep
the original solely for backup or archival purposes. You may not
copy the written materials accompanying the SOFTWARE. You may not
publish, sublicense, distribute or modify the SOFTWARE or
documentation or any copy without prior written consent of PCS
SOFTWARE.

3. OTHER RESTRICTIONS. You may not sell, rent, lease or
assign the SOFTWARE, but you may transfer your rights under this
Agreement, provided you transfer all copies of the SOFTWARE along
with written materials and the recipient agrees to the terms if this
License Agreement. Any transfer must include the most recent update
and all prior versions. You may not reverse engineer, decompile, or
disassemble the SOFTWARE.
LIMITED WARRANTY

LIMITED WARRANTY. PCS SOFTWARE warrants that the
SOFTWARE will perform substantially in accordance with the
accompanying written materials for a period of 90 days from the date
of receipt.

CUSTOMER REMEDIES. PCS SOFTWARES entire liability for any
failure of the SOFTWARE to comply with the forgoing Limited
Warranty and your exclusive remedy shall be, at PCS SOFTWARES
option, either (a) return of price paid or (b) repair or replacement
of the SOFTWARE that does not meet PCS SOFTWARES Limited Warranty
and which is returned to PCS SOFTWARE with a copy of your receipt.
This Limited Warranty is void if failure of the SOFTWARE has
resulted from accident, abuse, or misapplication. Any replacement
SOFTWARE will be warranted for the remainder of the original
warranty or 30 days, whichever is longer. In the event of refund
this License Agreement shall terminate.

NO OTHER WARRANTIES. PCS SOFTWARE DISCAIMS ALL
OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED,
INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR
PURPOSE, WITH RESPECT TO THE SOFTWARE, THE
ACCOMPANYING WRITTEN MATERIALS, AND ANY
ACCOMPANYING HARDWARE.

NO LIABILITY FOR DAMAGES. IN NO EVENT SHALL PCS
SOFTWARE OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES
WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DIRECT
DAMAGES, CONSEQUENTIAL DAMAGES AND OTHER
PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY
TO USE THIS PCS SOFTWARE PRODUCT, EVEN IF PCS
SOFTWARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
DAMAGES.
